Yorkshire Beds Online - The home of a fantastic range of sleep related products available from stock at Yorkshire prices. This section contains information on the terms and conditions relating to any purchase made from the Yorkshire Beds Online website. By using or accessing this website and/or placing any order(s), you agree to be legally bound by these terms and conditions. Your statutory rights as a consumer are unaffected by these conditions

  1. Definitions
    1. Conditions - the terms and conditions of sale set out in this document.
    2. Buyer - the person who buys or agrees to buy the Products from the Seller.
    3. Seller - means Yorkshire Beds Online.
    4. Consumer - the meaning as described in section 12 Unfair Contract Terms Act 1977.
    5. Products - the goods as specified.
    6. Price - the price for the Products including carriage, packing and VAT.
    7. Delivery date - the date specified by the Seller when the Products are to be delivered.
  2. The Products
    1. The quantity and description of the Products will be as set out in the Seller's quotation.
    2. The Seller may make any changes in the specification of the Products which do not materially affect their quality or performance required to conform with any applicable statutory requirements where the Products are supplied to the Seller's specification.
    3. All images and photographs are for illustrative purpose only, and may not exactly match the product itself.
  3. Warranties
    1. All goods supplied by the Seller come with a manufacturer's warranty of at least 12 months.
    2. In the event of a claim, the Buyer shall in the first instance contact the Seller's customer service department. The Seller shall provide the Buyer with such information as is required to claim under the manufacturer's warranties.
    3. The Seller's liability to the Buyer under these terms and conditions will be, at the Seller's discretion, to make good any shortage or non-delivery, to replace or repair any goods which are received in a damaged or defective state or to refund to you any sums actually paid by you for the goods in question. In so far as is permitted by law.
    4. The Seller will not be liable for any indirect or consequential loss or damage arising from any failure or delay in delivering goods which is caused by any event or circumstance deemed as beyond reasonable control.
  4. Delivery
    1. The Seller shall use any reasonable effort to meet any date agreed for delivery, which will be made door to door only unless otherwise stated.
    2. The Seller shall not be liable for any delay in delivery howsoever caused.
    3. All orders for delivery to addresses within mainland GB are delivered free of charge excluding the following:
    4. i) Postcodes - AB31-38, AB41-56, FK19-21, HS, IM1-9, IV1, IV3-56, TR21-25, BT47-57, BT74-82, BT92-94.
      ii) Regions - Grampians, Highlands, Isle of Wight, Channel Islands, Isle of Man, Northern Ireland, Dublin and Eire.
    5. Where an order contains more than one item the Seller will make reasonable effort to deliver all items at the same time once all items are available.
    6. Where a delivery date has been agreed with our carrier but the customer is unavailable to receive the delivery the Seller reserves the right to charge the customer a minimum of £20 to cover part of the cost of the failed delivery.
    7. The customer should only accept delivery of product after inspecting the goods for damage. Delivery drivers are obliged to wait up to 15 minutes to allow product to be inspected. Any product accepted without inspection should be signed for as such. Any damage to packaging or product should be noted on the delivery document. Neither The Yorkshire Bed Company, nor any 3rd party Carrier will be liable for any damage, or any costs incurred (including the cost of re-delivery) in rectifying any damage identified once the delivery has been signed for in good condition.
  5. Cancellations
    1. If the Buyer is dissatisfied with his purchase for any reason he may, within seven days of delivery, contact the Seller's customer service department to notify them that he wishes to return some or all items from his order.
  6. Returns
    1. If a cancellation is accepted products can be either returned by the Buyer to the Seller at his own cost or he may ask the Seller to collect the goods in which case he will be charged £29.99 which will be deducted from his refund.
    2. Goods must be returned to the Seller in the same condition they were in at the time of delivery to the Buyer and in their original packaging or similar.
    3. Items which are not adequately packaged at time of collection may not be collected and a charge of £29.99 may be levied to cover cost of failed collection.
    4. Refunds will be issued within 30 days of receipt of goods and after inspection for damage has taken place.
    5. The Seller reserves the right to withhold all or part of any refund if items are damaged in any way.
    6. Mattresses can only be returned if they are unopened. Mattresses which have been opened and slept on cannot be returned. If you wish to test a mattress please keep it wrapped until you are sure you want to keep it. Mattresses should be used only on a base affording adequate ventilation i.e. fabric divan or slatted base.
    7. Items that have been specially ordered are excluded from the returns policy. i.e. These items can not be returned.
    8. Custom made (including Harrison Bed Tailor products) are made to order, once payment is taken, no changes to the order or any cancellation may be made, except in accordance with your legal rights. Additionally we will only accept returns in accordance with your legal rights; for example:
    9. if there is a manufacturing defect with your bed
    10. if the bed has not been manufactured as specified
  7. Acceptance
    1. The Buyer shall be deemed to have accepted Products five working days after delivery to the Buyer has taken place. Following acceptance the Buyer is no longer entitled to reject Products which are not in accordance with the contract.
  8. Title & Risk
    1. Title of the Products shall not pass to the Buyer until the Seller has received payment in full in relation to the goods.
    2. Risk of damage to or loss of Products shall pass to the Buyer upon delivery.
  9. Liability
    1. Yorkshire Beds Online does not guarantee that use of this website will be compatible with all hardware and software that may be used by visitors to the site.
    2. Yorkshire Beds Online will be under no liability to you whatsoever whether in contract, tort, (including negligence), breach of statutory duty, restitution or otherwise for any injury, death, damage or direct, indirect or consequential loss (all three of which terms include, without limitation, pure economic loss, loss of profits, loss of business, depletion of goodwill and like loss) howsoever caused arising out of or in connection with the use of this website or the use, accessing, downloading or relying on any information or other materials contained in this website, including, without limitation, as a result of any computer virus.
    3. These terms and conditions do not exclude its liability (if any) to you for personal injury or death resulting from Yorkshire Beds Online's negligence, for fraud or for any matter which it would be illegal for Yorkshire Beds Online to exclude or to attempt to exclude its liability.
  10. General
    1. The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to strikes, lock outs, accidents, war, fire, flood reduction in or unavailability of power at the Seller's premises or associated manufacturing plant, any breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations.
    2. Unless otherwise stated it is the responsibility of the Buyer to assemble products where assembly is required.
    3. All sizes are approximate and it remains the responsibility of the Buyer to ensure products will fit into the delivery address prior to order.
    4. All delivery times are approximate.
    5. Any typographical, administrative or other error; in relation to any literature pertaining to a product, any quotation, price list, acceptance of offer, invoice or other document or information issued by the Seller shall be subject to correction without any liability on the part of the Seller.
    6. All the information on this website is given in good faith and subject to change without notice. By using this website you confirm that you have read and agreed to all terms and conditions as laid out in this section
  11. Law of Contract
    1. This Contract shall be governed by the law of England and Wales and any dispute, question or remedy howsoever arising will be determined exclusively by the Courts of England and Wales.
